THE WOMEN REVOLUTION: Supreme Court allows women to take NDA exam, goes heavy on Army for ‘gender discrimination’
India is the world’s largest democracy, with 1.2 billion people. Where it makes progress towards development goals, the lives of hundreds of millions of people can be improved: in recent decades, India has made substantial progress to improve child nutrition, immunisation rates and education enrolment rates, as well as to achieve broad economic growth. Yet, gender disparities persist against a backdrop of rapid economic growth: rates of violence against women are still high, women’s participation in government is low, and discriminatory dowry and inheritance practices continue.
The Constitution grants equality to women, ensures equality before the law, and prohibits discrimination against any citizen on the basis of religion, race, caste, sex or place of birth. It also allows ‘personal’ laws, however, resulting in a dual system that allows forms of discrimination against girls and women. A fresh change has been witnessed in Indian history as a new interim order was passed by the supreme court promoting gender equality.

The Supreme Court on Wednesday, 18th of August issued an interim order authorising women candidates to take the National Defense Academy examination, scheduled to be held on September 5, while introspecting why “co-education is a problem” in the Armed Forces.
“We consider it appropriate to issue an interim direction permitting the women candidates to take part in the examination scheduled for September 5, 2021, subject to further orders from this court. The Union Public Service Commission (UPSC) has chosen not to appear despite service. UPSC is directed to take out the necessary corrigendum in view of the interim orders we have passed today and give it wide publicity so that the intent of the order is translated into benefit at the ground level,” a Bench of Justices Sanjay Kishan Kaul and Hrishikesh Roy ordered.
The court shunned the Union of India’s affidavit “broadly” suggesting that Sainik schools have “started the process of admitting schools and it will be further expanded”.
